1. AGREEMENT TO TERMS
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “user”) and Binou (“we”, “us”, “our”), a company registered in Tunisia.
By accessing or using Binou’s services (the “Services”), you agree to be bound by these Terms. If you do not agree, you must not use the Services.
2. OUR SERVICES
Binou provides a platform for:
- appointment booking
- queue management
- customer flow management
- related tools for businesses (e.g., barbershops, salons)
You are responsible for ensuring that your use of the Services complies with all applicable laws.
3. USER ACCOUNTS
To use certain features, you may be required to create an account.
You agree to:
- provide accurate and up-to-date information
- keep your login credentials secure
- be fully responsible for all activity under your account
We may suspend or terminate accounts that violate these Terms.
4. SUBSCRIPTIONS AND PAYMENTS
Plans
Binou offers paid subscription plans for businesses.
Billing
- Payments are charged in Tunisian Dinar (TND)
- You agree to provide accurate payment information
Free Trial
A free trial may be offered. After the trial, access may be limited or suspended until payment is made.
Cancellation
- You can cancel anytime
- Cancellation takes effect at the end of the current billing cycle
- Payments are non-refundable
Pricing Changes
We may update pricing at any time with reasonable notice.
5. SMS NOTIFICATIONS
If you opt in, you may receive SMS notifications (e.g., appointment reminders, queue alerts). Message frequency depends on your activity.
You can opt out anytime by replying STOP. Standard carrier fees may apply.
6. ACCEPTABLE USE
You agree NOT to:
- use the platform for illegal activities
- attempt to hack, disrupt, or overload the system
- impersonate others
- collect user data without permission
- misuse the platform for spam or abuse
We reserve the right to suspend or terminate accounts violating these rules.
7. USER CONTENT
You may submit content (e.g., reviews, messages, business info).
You agree:
- you own or have rights to your content
- your content is not illegal, abusive, or misleading
We may remove content that violates these Terms.
8. INTELLECTUAL PROPERTY
All platform content, including software, design, and branding, belongs to Binou or its licensors.
You may not copy, reproduce, or exploit any part of the Services without permission.
9. THIRD-PARTY SERVICES
Binou may integrate with third-party services (e.g., payments, messaging).
We are not responsible for third-party service availability, their policies or actions. Use them at your own risk.
10. SERVICE AVAILABILITY
We strive to keep the Services available at all times. However, interruptions may occur and we do not guarantee uninterrupted access.
11. TERMINATION
We may suspend or terminate your account at any time if you violate these Terms or your use harms the platform or other users.
You may stop using the Services at any time.
12. DISCLAIMER
The Services are provided “as is” and “as available.”
We do not guarantee error-free operation, uninterrupted access, or specific results from using the platform.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Binou is not liable for indirect or incidental damages, or loss of data, revenue, or business.
Our total liability is limited to the amount you paid in the last 6 months.
14. INDEMNIFICATION
You agree to indemnify and hold Binou harmless from any claims resulting from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party rights.
15. DATA AND PRIVACY
Your use of the Services is also governed by our Privacy Policy: binou.app/privacy
16. GOVERNING LAW
These Terms are governed by the laws of Tunisia.
Any disputes will be resolved in Tunisian courts.
17. CHANGES TO THESE TERMS
We may update these Terms at any time.
Continued use of the Services means you accept the updated Terms.
